1 General Provisions

Operator of the Trendbolt Online Shop and the Validity of these General Terms and Conditions

The Trendbolt Online Shop is operated by Tatyjana Bajdak (Austria Vienna 1030 Lilienthalgasse 9). Managing Director: Tatyjana Bajdak.

Only these terms and conditions apply to the sale of merchandise by us. Any other terms and conditions will only apply if they have been accepted by us.

We sell merchandise solely to end users and only in normal household volumes.

2 Contract Closure

2.1 contract closure regarding standard products

The presentation of our merchandise invites you to submit a purchase offer in the form of an order. Clicking the Order button in the last stage of the ordering process issues a binding order for the products you have placed in the shopping basket. As soon as your order has been received by us, you will receive an automatically generated order confirmation by email.

2.2 contract closure regarding personalized products

After you have placed your order for a personalized product, we will send an order confirmation to you by E-Mail. When you receive this order confirmation, your order is accepted and a binding contract of sale is concluded between you and us.

3 Accepting the Order

An order that is binding for you comes into effect when all of the data necessary to complete the contract has been entered, you have confirmed acceptance of these terms and conditions and you have clicked the Order button. Up until the moment you click this button, you can change your order and the data associated with your order at any time.

We reserve the right to accept an order. The decision is made at the discretion of Trendbolt Online Shop. If an order is not executed, we will inform you immediately by email. The confirmation of receipt does not constitute a purchase contract; the confirmation of receipt only documents that your order has been received by us.

4 Payment

All prices specified for merchandise in the Online Shop already contain the relevant valid VAT.

You can choose from a number of different payment types:

  • Paying by credit card (via PayPal)
  • Paying with PayPal

Please note that agreements you may have with your credit institute or other institutions may result in additional costs for electronic transfers, holding an account, etc.

5 Retention of Title

Until such time as full payment has been received, the merchandise remains our property.

6 Statutory right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right of withdrawal, you must inform us at e-mail: info@trendbolt.eu of your decision to withdraw from this contract by an unequivocal statement (a letter sent by post or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period (14 days) has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay after we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, with the exception of cash on delivery. The return shipping costs are paid by the client. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods. You shall send back the goods to:

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. Please note that full refund is issued only if the returned goods are in their original state, i.e. unused/undamaged.

7 Guarantee

Your legal guarantee claim period is defined by the law and starts with receipt of the merchandise. During this time, we will eliminate all faults that fall under the legal guarantee obligation. You can demand either the elimination of the fault, or the delivery of a fault-free item, although the right to choose may be limited by the existence of legal prerequisites. If it is not possible to provide a replacement, you may choose to withdraw from the sales contract or to accept a discount. The legal claim for damages only applies to the replacement of damages, and not compensation/replacement for any failed attempts on your part to repair item.

8 Privacy Policy

All personal data is fundamentally treated in the strictest of confidence. Your personal data is used to enable the optimum handling of the order, to deliver the merchandise, and to provide services and to handle payments. For this purpose, we pass your data on to authorised service providers and, if necessary, to associated companies.

For the purpose of payment processing the necessary data is stored both on our server and on the servers of the companies we have authorized to handle payment processing.

In addition, data, for example, name, date-of-birth and address will be passed to financial information services for the purpose of checking your credit and credit worthiness.

1. Collecting Personal Data

We use our systems to gather the following information:

Information that is collected automatically: As soon as you visit our websites, we collect and store certain information automatically. This information includes Internet protocol addresses (IP), the type and version of browser you are using, your operating system and platform, including the uniform resource locator (URL). We store this data in a completely anonymous way.

Information that you provide us with: Personal data you share with us in the course of submitting an order remain completely confidential. This includes, for example, your contact data, and your birth date and telephone number, including your payment information.

2. Using Your Data to Process Your Order

We use the personal information that you provide us with as part of the order process, to deliver the goods, to arrange payment and to send you information about your order. We require the following data to do this: contact information including title, first name, last name, street address, postal code, city, country, email address, birth date (to make sure the customer is over the age of 16) and phone number (in case we have any questions about your order).

For the purpose of payment processing the necessary data is stored both on our server and on the servers of the companies we have authorized to handle payment processing.

3. Using Your Data for Advertising Purposes

We use your information for promotional purposes (direct marketing, newsletters, etc.) only as permitted by law and only if you have given your express permission for this purpose by signing this contract. This permission can be revoked at any time.

Newsletter and product offers by e-mail

If you register for the Trendbolt Online Shop newsletter, you will receive regular product recommendations/updates from us that we will send to your specified email address). We use your information in this regard for promotional purposes, and to provide you with information about our range of products. These offers might be based on your past orders. The data that is required to send the newsletters is forwarded to the companies Trendbolt Online Shop has commissioned for handling shipping and is therefore stored on servers in the United States and EU. These partners in turn provide Trendbolt Online Shop with information related to emails that have been sent to you and confirmation that they have been read, information regarding your computer and Internet access, operating system and platform, date and time of the visit to the site and the products you have viewed.

4. Passing Your Personal Data on to Third Parties

We will not pass on your personal data to anyone not included in this data privacy statement. The only exception to this would be to serve legal obligations. 

Information collected by my shop

To fulfil your order, you must provide me with certain information, such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order, for example), if you contact me directly.

I share your personal information for very limited reasons and in limited circumstances, as follows:

Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 2 years.

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases:

Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

5. Cookies

At various points on our website, we use "cookies." Cookies are small text files that the web browser stores on your hard drive. We use cookies in order to track visitor preferences, which enables us to tailor our website and improve our offer for you.

In general, no personal data is stored in the cookies that the Trendbolt Online Store uses. That way, none of the cookies can be attributed to you or anyone else. An identification number is assigned to a cookie when it is activated. Cookie technology only supplies us with anonymous information, for example, data regarding which pages a customer visited in our online store, which products were viewed, etc. Personal details can be saved in cookies if you give your consent. For example, in order to facilitate secure online access so that you do not have to retype your user ID and password each time you visit the site, your user ID and password can be saved in cookies to make logging in to our website easier and faster.

Cookies make navigating and visiting web sites much more user friendly.

They enable our systems, for example, to recognize your browser, save your basket between visits, or to offer you suitable products on other websites (e.g. product provided by partners whose websites contain Trendbolt Online Shop content).

You can also view our website without cookies. However, this can lead to function restrictions on our site (for example, regarding using the shopping cart).

6. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. 
In case of activation of the IP anonymization, Google will anonymize the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. 

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to use the full functionality of this website. 


7. Protecting Your Data

We secure our website and other systems against loss, destruction, unauthorized access, modification or distribution of your data by unauthorized persons by implementing the appropriate technical and organizational measures. Furthermore, your personal data is transmitted to us in encrypted format. This applies to your order and when you log in as a customer.

8. Right to Information and Right to Object

There is a right to information about your personal data that we store and the right to rectification, blocking and deleting your stored personal data.

You have the right to object to the use or processing of your data at any time. You have the right to revoke any consent you have previously granted us regarding the use of your personal data.
